Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AthletesNow! application and website (the "Service"), operated by AthletesNow LLC ("AthletesNow!", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility & Accounts
- You must provide accurate information and keep it current.
- Athlete accounts are available to student-athletes; users below the age of majority may be required to use a parent or guardian co-account.
- School, pro team, and agent accounts require verification, and agents must maintain valid union certification where applicable.
- You are responsible for activity under your account and for keeping your credentials secure.
Subscriptions, Pricing & Billing
Some features require a paid subscription. Current tiers include athlete plans (Free, $4.99/mo, and $9.99/mo), school plans ($499, $999, and $2,999/mo), pro franchise plans, agent plans ($299, $999, and $2,499/mo), and an Olympic Development tier (Coming Q4 2026). Prices are shown in the app and may change with notice. Subscriptions purchased through the Apple App Store or Google Play are billed and managed by those platforms, and renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your platform account settings. Except where required by law or platform policy, payments are non-refundable.
Acceptable Use
You agree not to:
- Upload content you do not have the right to share, or that infringes others' rights.
- Impersonate any person or misrepresent your affiliation, eligibility, or credentials.
- Remove, alter, or circumvent watermarks or other protective measures.
- Harass, exploit, or endanger any user, particularly minors.
- Scrape, reverse engineer, or interfere with the Service.
- Use the Service to violate NCAA rules, league rules, or applicable law.
User Content
You retain ownership of the content you upload. You grant AthletesNow! a limited, non-exclusive license to host, display, and distribute your content within the Service for the purpose of operating it (for example, showing your profile to users you have allowed). You are responsible for your content and represent that you have the rights necessary to share it.
Video Watermarking
All uploaded video is automatically watermarked. Before each upload you must affirmatively acknowledge and consent to watermarking; this acknowledgment is required every time and is timestamped. Watermarking is a protective feature and not a guarantee against third-party misuse.
NIL Disclaimer
AthletesNow! provides informational tools (including an NIL score) and does not provide legal, financial, tax, or eligibility advice. NIL rules vary by jurisdiction, institution, and governing body and change frequently. You are solely responsible for ensuring that any name, image, and likeness activity complies with all applicable rules. Consult qualified advisors and your compliance office before acting.
NCAA & League Compliance
AthletesNow! includes features intended to support compliance with recruiting rules, but you remain solely responsible for your own compliance. AthletesNow! is an independent platform and is not affiliated with, endorsed by, or sponsored by the NCAA or any league, team, or players' association. We do not guarantee eligibility outcomes.
Platform Neutrality (Section 230)
The Service hosts content created by users. Consistent with Section 230 of the U.S. Communications Decency Act, AthletesNow! is not the publisher or speaker of user-provided content and is not liable for it. We may, but are not obligated to, moderate, remove, or restrict content at our discretion.
Intellectual Property
The AthletesNow! name, logo, and the Service (excluding user content) are owned by AthletesNow LLC and protected by intellectual property laws, including pending trademark and patent filings. You may not use our marks without permission.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination will survive.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
Limitation of Liability
To the maximum extent permitted by law, AthletesNow LLC and its officers, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
Indemnification
You agree to indemnify and hold harmless AthletesNow LLC from claims arising out of your content, your use of the Service, or your violation of these Terms or applicable law.
Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Wyoming, unless applicable law provides otherwise.
Changes to These Terms
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use after changes take effect constitutes acceptance.
